A speeding ticket in NYC is a NYC traffic violation that carries both a fine and points on your license.
FINE: $45 – $600
POINTS: 3 – 11 points
WHERE TO FIGHT THE NYC TRAFFIC VIOLATION:
New York City has special Bureaus (courts) to handle speeding tickets in NYC and other NYC traffic violations, which is the New York State Department of Motor Vehicles (DMV) Traffic Violations Bureau (TVB). The TVB does not handle criminal driving offenses, such as driving while intoxicated and driving with a suspended or revoked (aggravated unlicensed operation). TVBs do not handle parking violations.
Specifically; The TVB handles traffic tickets issued in:
- The five boroughs of New York City
- The cities of Buffalo and Rochester
- Portions of the towns of Babylon, Brookhaven, Huntington, Islip, Riverhead and Smithtown in Suffolk County
HOW TO HANDLE A NYC SPEEDING TICKET
If you plead not guilty to a traffic ticket in a TVB ‘court’, your case will be heard by a DMV Administrative Law Judge (ALJ). An ALJ is an experienced attorney with special training in the Vehicle and Traffic Law and will decide whether or not you are guilty and will set a fine if you are found guilty. An ALJ also has the authority to revoke or suspend your driver license and/or auto registration when required by law or when the ALJ believes it is in the interest of traffic safety.
If you got a speeding ticket that was given using a laser gun, here’s a great article that explains how a laser gun works and how to fight a laser gun speeding ticket, written by Weiss & Associates.
You cannot make a ‘deal’ with the TVB. You either win or lose.
Find out why these 5 defenses for NYC speeding tickets won’t work:
- “I was going with traffic”
- “My speedometer was broken”
- “Everyone was speeding but I was the only one pulled over”
- “The officer was rude”
- “The officer told me that this was no points”
